Amendment Of The WeLiveIT Basic Terms And Conditions

WeLiveIT reserves the right to amend its standard terms and conditions from time to time, subject to the provisions of the Consumer Protection Act, 68 of 2008, in so far as these amendments may relate to a Consumer, as defined.

Fees and Payment

This clause outlines the fees, payment terms, and deposit requirements associated with WeLiveIT’s website development services. By engaging our services, you, the Customer, acknowledge your understanding of these terms and agree to abide by them.

  1. Deposit Requirements:

To initiate a project, WeLiveIT requires a deposit of 50% of the total estimated cost for labor. Additionally, all hardware equipment, if necessary for the project, must be paid for in full upfront before any work commences. The deposit serves to secure your project’s place in our development queue and covers initial costs and resources.

  • Payment Terms:

Payment for our services is due before any work begins. WeLiveIT accepts various payment methods, which will be
outlined in the invoice you receive. Invoices will be issued based on the project’s progress or in accordance with an agreed-upon payment schedule. Please ensure timely payment to avoid disruptions to the project timeline.

  1. Payment Delays and Suspension:

WeLiveIT takes payment deadlines seriously. In the event that full payment for services rendered is not received within 5 days after project completion, WeLiveIT reserves the right to suspend the project and any associated services until payment is received. We will make reasonable efforts to notify you of the outstanding balance before implementing any service suspension.

  1. Clients Waiving the Deposit:

Some clients may have negotiated a specific agreement with WeLiveIT that waives the initial deposit requirement. If such an agreement is in place, it is crucial to understand that full payment for the project becomes due upon project completion. WeLiveIT will invoice you for the entire project amount, and this invoice must be settled promptly as per the payment terms outlined in this agreement.

  1. Service Termination:

In the event of non-payment or other breaches of these terms and conditions, WeLiveIT reserves the right to terminate the project, withdraw services, and seek legal remedies as necessary. Service termination may result in delays and additional costs for the client, and WeLiveIT will not be liable for any such consequences.

By continuing to engage WeLiveIT’s website development services, you acknowledge and agree to these payment terms and conditions. It is essential to stay informed about any changes to our pricing and fulfill your payment obligations in a timely manner to ensure a smooth project experience.

Products

  1. We will exert reasonable efforts to ensure the timely delivery of the Products as per the specified date in the Order. For all hardware products, delivery is offered at an extra charge as specified on the order. It is imperative that you are prepared to receive the delivery on the specified date or any alternative date agreed upon. In the event that we encounter challenges in delivering the Products on the initially specified date, we will collaborate with you to establish a revised delivery date. For Software specifically, we commit to utilizing reasonable efforts to make the Software available for download by the date outlined in the Order. It is important to note that the risk associated with the Products’ transitions to you upon delivery.
  2. Should you opt to utilize your own carrier for Product delivery, the delivery is deemed to occur when we make the Products accessible to your carrier for collection, prior to loading. All costs, expenses, losses, or liabilities arising from the transportation of these Products will be borne by you. 
  3. Delivery Delivery times are estimates only, and WeLiveIT cannot be held liable for late deliveries.  WeLiveIT reserves the right to verify the identity of any purchaser or the payment method used. Risk in the products shall pass to you or your authorized representative upon delivery.  For more information about delivery, please see our Shipping & Delivery Policy, which is incorporated into these terms by reference.  Delivery fees are subject to change at any time without prior notice
  4. Cancellations  In accordance with section 44 of the Electronic Communications and Transactions Act 25 of 2002 (“ECT Act”), you are entitled to cancel, without reason and without penalty, your order for the Products within 7 (seven) days of receipt of the Products. In such an event, you will be liable, as per section 44(2) of the ECT Act, for the direct costs of returning the products, such as courier and/or shipping charges. For more information about cancellations, please refer to our FAQs, which are incorporated into these terms by reference.
  5. Conclusion of Sale and Stock Availability Registered users may place orders for items which WeLiveIT may accept or reject based on the availability of stock, correctness of the information relating to the items, including price, and receipt of payment.  WeLiveIT will indicate acceptance of your order by delivering the items to you or allowing you to collect them. Only at this point will a sale agreement between you and WeLiveIT take place.  Orders may not be cancelled once payment has been made. However, you may return the items in accordance with our Returns Policy after receiving delivery. WeLiveIT reserves the right to cancel any order for any reason, with notice to you, without liability. You acknowledge that stock of all items on offer is limited, and pricing can change at any time without prior notice.  As erroneous information and/or prices may occur on the website, you agree that WeLiveIT cannot be held liable for any inaccurate information and/or prices published. We will not, under any circumstances, be obligated to sell a product at an erroneous price. Please inform us of any errors by emailing info@weliveit.co.za.  Placing items in a shopping cart without completing the transaction does not constitute an order for such items. As such, items may be removed from the shopping cart if stock is no longer available or the price has changed.

Returns Policy

We aim for your satisfaction with your purchase. In the event that you are not entirely pleased, you may return the product to us, and, subject to the terms outlined below, we will either repair/replace or credit your account.

To facilitate the swift processing of your request, it is incumbent upon you to:

  1. Package your items securely and safely to ensure protection during transit.
    2. Include all accessories and parts originally sold with the product.
    3. Email your return request to info@weliveit.co.za, providing:
    – Your invoice number
    – The item you intend to return
    – The reason for the return

Defective Products

A defect is a significant imperfection in the manufacturing of a product or any characteristic that renders the product less acceptable than one would reasonably expect. The following instances will not be considered as defects and will not warrant a return:

  1. Faults resulting from normal wear and tear.
  2. Damage arising from negligence, user abuse, or incorrect usage of the product.
  3. Problems resulting from electrical surges or sea air corrosion.
  4. Damage stemming from a failure to adequately care for the product.
  5. Faults that arise in transit after arrival if client used their own transportation as we would have tested the products with the client before dispatch.
  6. Damage caused by unauthorized alterations to the product.
  7. Depletion of consumables due to use of generic toners and or parts.
  8. Cases where the specifications of a product, despite being accurately described on the website or Invoice and generally suitable for its intended purpose, do not align with your specific requirements.

Please be advised that failure to adhere to these stipulations may lead to delays in processing your refund request or, in some cases, result in its outright rejection.

Product Warranty and Refund Policy

1. Products sold by WeLiveIT are covered by a manufacturer’s warranty.
2. Warranty periods vary depending on the product and manufacturer.
3. Warranty claims must be made within the specified warranty period.
4. Refunds or replacements will only be provided for defective products within the warranty period.
5. Products damaged by electrical surges, natural disasters, or user negligence are not eligible for refunds or warranty claims.
6. Products with expired or voided warranties are not eligible for refunds or warranty claims.

Product Return Policy

1. Returns are only accepted for defective products within the warranty period.
2. Returns must be accompanied by original packaging, accessories, and proof of purchase.
3. Refunds will be processed within 7 days of receiving returned products.
4. Refunds will be issued in the original payment method.

Product Cancellation Policy

1. Orders may be cancelled within 7 days of receipt, in accordance with the ECT Act.
2. Cancellations are subject to a 10% administration fee.
3. Cancellations after 7 days will incur additional fees.

Limitation of Liability

1. WeLiveIT shall not be liable for damages or losses arising from product use or misuse.
2. WeLiveIT shall not be liable for indirect, incidental, special, or consequential damages.

Customer Responsibilities

Customers are responsible for providing us with accurate and complete information necessary for us to provide our services. Customers must also comply with all applicable laws, regulations, and policies related to the use of our services.

Intellectual Property Rights

All intellectual property related to our services, including but not limited to software, content, and designs, are owned by us and protected by copyright, trademark, and other intellectual property laws. Customers may not use our intellectual property without our prior written consent.

Confidentiality

We respect the privacy of our customers and will keep all customer information confidential. We will not disclose any customer information to any third party without the customer’s prior written consent, except as required by law.

Limitation of Liability

We shall not be responsible for any damages or losses arising from the use of our services. We do not warrant that our services will be error-free or uninterrupted. In no event shall we be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the use of our services.

Termination

Customers may terminate their use of our services at any time. We reserve the right to terminate a customer’s use of our services at any time and for any reason on notice where this is possible, or without notice where this is not possible.

Governing Law

These terms and conditions shall be governed by and construed in accordance with the laws of The Republic of South Africa without giving effect to any principles of conflicts of law.

Changes to Terms and Conditions

WeLiveIT reserves the right to modify these terms and conditions at any time.

Entire Agreement

These terms and conditions constitute the entire agreement between us and our customers and supersede all prior agreements and understandings, whether written or oral.
